These Terms govern your use of the TMMT Operator platform and the AIXMOS operating system (the "Platform"), provided by TMMT Auto Services LLC, a Virginia limited liability company ("TMMT," "we," "us"). By creating an account, subscribing, or using the Platform, you agree to these Terms.
⚠️ Please read this first — what this is and is not
TMMT sells software and education. That is all. We are not a credit repair organization, not a credit services organization, not a lender, not a broker, not a law firm, and not a financial advisor. We do not repair credit, dispute items on your behalf, contact credit bureaus for you, or arrange financing. Nothing on this Platform is legal, financial, tax, or investment advice.
1. What Your Subscription Includes
A paid subscription grants you a limited, non-exclusive, non-transferable, revocable license to access the Platform for your own business use during your paid term. It includes:
- Access to the AIXMOS operator software environment
- Access to the operator education curriculum and standard operating procedures
- A monthly allotment of platform tokens (see Pricing)
- Support as described in your plan
Your license is to use the Platform. It is not a sale, and it transfers no ownership. See Section 6.
2. You Are an Independent Business
You are an independent contractor and independent business owner. Nothing in these Terms creates a partnership, joint venture, franchise, employment, or agency relationship between you and TMMT.
- You control your own schedule, methods, clients, pricing, and business decisions.
- You are solely responsible for your own business entity, licenses, registrations, bonds, insurance, and taxes.
- You may not hold yourself out as an employee, agent, or representative of TMMT, or bind TMMT to anything.
- You are solely responsible for compliance with every law that applies to your business.
3. Regulated Activity — Your Responsibility Alone
Some operators run businesses in regulated fields. If you do, you do so entirely on your own account, through your own legal entity, and at your own risk and liability.
Specifically, and without limiting the above:
- TMMT does not provide credit repair services and does not supply, review, approve, or transmit consumer dispute correspondence.
- If your business is subject to the federal Credit Repair Organizations Act (15 U.S.C. § 1679 et seq.), the FTC Telemarketing Sales Rule (16 C.F.R. Part 310), or any state credit services or consumer protection statute, you — not TMMT — are the regulated entity, and you are responsible for your own registrations, surety bonds, contracts, and consumer disclosures.
- You will not use the Platform for any prohibited activity, including but not limited to: CPN or "credit privacy number" schemes, rented or purchased tradelines, synthetic identities, misrepresenting consumer information, or any activity that is fraudulent or unlawful. This prohibition is permanent and is not waivable.
- You agree to indemnify TMMT as set out in Section 9 for any claim arising from your regulated activity.
4. No Earnings Claims or Guarantees
TMMT makes no representation, promise, or guarantee regarding income, earnings, profit, or business success. Any figures, examples, case studies, or results described anywhere on this Platform are illustrative only and are not typical, not average, and not a promise of what you will earn. Your results depend on your own effort, skill, market, capital, and factors outside anyone's control. You may earn nothing. You may lose money. You should not subscribe based on any expectation of a particular financial result.
5. Payment, Renewal, and Cancellation
- Subscriptions bill in advance on a recurring monthly basis at the rate shown at checkout.
- Your subscription renews automatically each month until you cancel.
- You may cancel at any time and your access continues through the end of the period you have already paid for. See our Refund Policy.
- If a payment fails, we may suspend access until the balance clears.
- We may change pricing on 30 days' written notice; changes apply to your next renewal, never retroactively.
- Fees are exclusive of any taxes, which are your responsibility.
6. Intellectual Property
The Platform, the AIXMOS system, the TMMT operating system, all curriculum, documentation, software, templates, SOPs, and all related intellectual property are and remain the exclusive property of TMMT Auto Services LLC and its owner. You receive a license to use them, nothing more.
You may not: copy, resell, sublicense, white-label, reverse engineer, scrape, or redistribute the Platform or its materials; use them to build a competing product; or share your credentials. Content you create for your own clients using the Platform remains yours.
7. Acceptable Use
You will not use the Platform to: violate any law; infringe anyone's rights; send unlawful, deceptive, or unsolicited communications; misrepresent your identity or affiliation; attempt to gain unauthorized access to any system or another user's data; or interfere with the Platform's operation or security.
8. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that it will produce any particular result.
9. Limitation of Liability and Indemnity
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TMMT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATING TO THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY.
TMMT'S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TMMT IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Indemnification. You will defend, indemnify, and hold harmless TMMT Auto Services LLC, its owner, members, officers, and affiliates from and against any claim, demand, investigation, proceeding, loss, liability, damage, fine, penalty, cost, or expense (including reasonable attorneys' fees) arising out of or relating to: (a) your business, its operations, and its clients; (b) your use of the Platform; (c) your breach of these Terms; (d) your violation of any law or the rights of any third party; and (e) any regulated activity you conduct, including any claim under the Credit Repair Organizations Act, the Telemarketing Sales Rule, or any state credit services, licensing, bonding, or consumer protection law. This obligation survives termination.
10. Termination
You may cancel at any time. We may suspend or terminate your access immediately and without refund if you breach these Terms, engage in prohibited activity under Section 3, or if your conduct creates legal, regulatory, or reputational risk to TMMT. We may also terminate for convenience on 30 days' notice, in which case we will refund any unused prepaid portion of your then-current term.
On termination your license ends and you must stop using the Platform and its materials. Sections 3, 4, 6, 8, 9, 10, 11, and 12 survive.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. The parties will first attempt to resolve any dispute through good-faith negotiation for 30 days. Any dispute not so resolved will be brought exclusively in the state or federal courts located in Fairfax County, Virginia, and you consent to that jurisdiction and venue.
12. General
- Entire agreement. These Terms, plus any signed operator agreement between us, are the entire agreement. If a signed operator agreement conflicts with these Terms, the signed agreement controls.
- Changes. We may update these Terms; material changes take effect on your next renewal, and continued use after that is acceptance.
- Severability. If any provision is unenforceable, the rest stays in force.
- No waiver. Not enforcing a right once doesn't waive it.
- Assignment. You may not assign these Terms without our written consent. We may assign them.
